EPA Delays PIP (3:1) Enforcement up to 180 Days

By: SiliconExpert on March 16th, 2021

In March 2021, the EPA announced a 60-day public comment period to collect additional input on five final rules for persistent, bio accumulative and toxic (PBT) chemicals issued  January 6, 2021 under the Toxic Substances Control Act (TSCA).

The EPA is issuing a temporary 180-day “No Action Assurance”. This extends their original compliance date of March 8, 2021. The agency is taking this action to ensure the supply chain of these important articles is not negatively affecting while the EPA continues to collect  information needed to make a well informed issuance of final agency action for regulatory efforts.

The agency will exercise its enforcement discretion regarding prohibitions on processing and distribution of PIP (3:1) for use in articles, and the articles to which PIP (3:1) has been added.
